Attorney – Execution & Special Projects

About the role

The Attorney (Execution & Special Projects) will lead the identification, revival and enforcement of judgment‑granted matters, developing and executing effective recovery strategies across both movable and immovable assets.

Key responsibilities

• Identify suitable judgments for execution and design optimal recovery plans.
• Manage end‑to‑end execution processes, including warrants of execution.
• Investigate and trace historic or aged judgments with incomplete documentation.
• Recover and verify court records, judgment documents and supporting evidence.
• Draft and manage applications to revive and enforce historic judgments (Rule 66, Section 63, Section 64 and ancillary applications).
• Handle substitution applications for ceded, sold or transferred judgments.
• Conduct Section 65 Financial Enquiries to assess debtor affordability and payment capacity.
• Evaluate debtor solvency and initiate sequestration proceedings where viable.
• Engage with sheriffs, courts, trustees and other stakeholders to drive matters to finality.
• Monitor execution returns, financial enquiry outcomes and identify further recovery opportunities.
• Develop and implement legal recovery strategies to maximise collections and revenue.
• Ensure compliance with legislation, court rules and client mandates throughout all proceedings.

Required profile

• Degree in Law (B Proc, LLB, LLM); admission as an Attorney by the High Court of South Africa.
• Minimum of 5 years’ legal experience, including at least 3 years in the legal collections industry.
• Proven experience in civil litigation and debt collection.
• Familiarity with the Uniform Rules of Court, Magistrates’ Court Act and Superior Courts Act.
