Senior Foreclosures Attorney (Property Law & Financial Recoveries)

Key responsibilities

• Strategically manage both undefended and defended foreclosure and secured asset litigation portfolios, including risk assessment and strategy formulation.
• Draft and settle complex pleadings such as Particulars of Claim, Affidavits, Heads of Argument and appeal documentation.
• Oversee execution processes, including warrants of attachment, sales in execution and coordination with sheriffs and conveyancers.
• Lead and mentor a legal team, handling performance management, workflow allocation and quality assurance.
• Engage directly with banking executives and credit risk stakeholders, providing litigation strategy updates and recovery forecasts.

Required profile

• Admitted Attorney of the High Court of South Africa with at least 10 years post‑admission experience.
• Extensive senior‑level experience in high‑value banking litigation, including defended trials and opposed applications.
• Proven expertise in foreclosure, insolvency, deceased estates, business rescue and liquidation matters where financial institutions are secured creditors.
• Strong knowledge of the National Credit Act, Insolvency Act, Administration of Estates Act, Companies Act, Uniform Rules of Court and Superior Courts Act.

Required skills

• Advanced drafting using Microsoft Word.
• Data analysis and reporting with Microsoft Excel.
• Proficiency in Microsoft Outlook for communication.
• Working knowledge of legal case management systems (e.g., DM1, CACS, Excalibur, OCS, Lexpro).
• Familiarity with digital court platforms and electronic document management systems.
